FREQUENTLY ASKED QUESTIONS

Who does the Receiver represent?

The receiver acts as the agent of the court for the benefit of all who may have an interest in the receivership property.  While the receiver is usually appointed at the request of secured creditors, the law mandates that the receiver is not beholden to the creditors and maintains impartiality.  The receiver is required to take an oath and post a bond to ensure lack of prejudice against any party.
