When is a Receivership used?

A receivership is put into place when the court finds it is in the best interests of those holding an interest in the property that a third party is charged with overseeing the management of the receivership estate.  This is a remedy used when other standardized remedies, such as one party making good on a contractual obligation, are insufficient to accomplish a fair result.
